TERMS AND CONDITIONS

1. About Lowkidz

Lowkidz is an online store based in Belgium offering a curated selection of clothing and accessories for babies and children.

These Terms and Conditions apply to purchases made through the Lowkidz online store. By placing an order, you agree to these Terms and Conditions.

Nothing in these Terms affects any mandatory rights you have as a consumer under Belgian or European Union law.

2. Products

We make every effort to describe and photograph our products as accurately as possible.

Colours may appear slightly different depending on your screen settings. As many of our products are made from natural fibres and materials, slight variations in colour, texture or finish may also occur and are not necessarily defects.

Product availability is subject to stock.

3. Prices and VAT

All prices shown on the Lowkidz online store are in euros (€) and include VAT where applicable.

Any shipping costs are shown separately before you confirm your order.

The total amount payable, including applicable taxes and delivery charges, will be displayed before you place your order.

Lowkidz may change prices at any time. However, the price applicable to your order is the price displayed at the time the order is placed.

4. Orders and payment

Placing an order constitutes an offer to purchase the selected products.

After placing an order, you will receive an order confirmation by e-mail. Lowkidz reserves the right to refuse or cancel an order in exceptional circumstances, for example in the event of an obvious pricing error, suspected fraud or if an item is unexpectedly unavailable.

If we cancel an order after payment has been received, the amount paid will be refunded.

Available payment methods are displayed during checkout.

5. Shipping and delivery

Lowkidz currently ships to the destinations indicated on the website.

Available delivery methods, shipping costs and any free-shipping thresholds are shown during checkout before the order is confirmed.

Estimated delivery times are indicative. We will make reasonable efforts to dispatch and deliver orders within the indicated timeframe.

The risk of loss or damage to the goods remains with Lowkidz until you, or a third party designated by you other than the carrier, physically receive the goods. This follows EU consumer rules on delivery risk.

If there is an unusual delay or a delivery problem, please contact us so that we can investigate it with the carrier.

6. Right of withdrawal and returns

Consumers have a statutory right of withdrawal for online purchases, subject to the exceptions provided by law.

Details regarding the 14-day withdrawal period, return procedure, return costs and refunds are set out in our Return & Refund Policy, which forms part of these Terms.

Nothing in our Return & Refund Policy limits your statutory consumer rights.

7. Defective or non-conforming goods

All consumer goods sold by Lowkidz are covered by the applicable legal guarantee of conformity.

Under Belgian and EU consumer law, consumers benefit from a legal guarantee of at least two years for goods that are defective or do not conform to what was ordered.

If you receive an item that is defective, damaged or incorrect, please contact us as soon as possible at hello@lowkidz.com.

Depending on the circumstances and the applicable legal rules, you may be entitled to repair, replacement, a price reduction or reimbursement.

8. Liability

Lowkidz is responsible for fulfilling its legal and contractual obligations.

We are not responsible for damage resulting from misuse of a product, failure to follow care instructions, normal wear and tear, or circumstances outside our reasonable control, except where liability cannot legally be excluded or limited.

Nothing in these Terms excludes or limits any liability or consumer right that cannot be excluded or limited under applicable law.

9. Intellectual property

Unless otherwise stated, the content of the Lowkidz website, including its texts, photographs, graphics, branding and logo, belongs to Lowkidz or is used with the permission of the relevant rights holder.

Content may not be reproduced, distributed or used for commercial purposes without prior written permission.

Third-party brand names, trademarks and product images remain the property of their respective owners.

10. Privacy

Personal data is processed in accordance with our Privacy Policy.

Shopify provides the e-commerce infrastructure used by Lowkidz and may process certain personal data as described in the applicable privacy information.

11. Changes to these Terms

We may update these Terms and Conditions from time to time, for example to reflect changes to our services or applicable law.

The version applicable to an order is the version in force when that order is placed.

12. Applicable law

These Terms and Conditions are governed by Belgian law.

If you are a consumer living in another EU Member State, this choice of law does not deprive you of any mandatory consumer protection granted to you by the laws of your country of residence.

Any dispute should preferably first be addressed to Lowkidz so that we can try to resolve it amicably.
